20:29Biritiba Mirim are hereby established .

20:32Article 2 . These are the guidelines of

20:37the municipal policy dealt with in this

20:41law . Promotion of respect for the

20:45dignity and rights of people with

21:45actions dealt with in this law may be

21:47developed in an integrated manner with

21:49public policies and activities already

21:51existing in the municipality . Article 5

21:55. The application of this law shall

21:59observe the relevant federal and state

22:02legislation , especially the rules

22:04regarding the rights of people with

22:06disabilities and accessibility . Article

22:106 . The execution of actions resulting

22:13from this law will observe the

22:15budgetary and financial availability of

22:17the municipality . Article 7 . This law

22:22does not create positions , functions ,

22:25or jobs . public , agencies , or

22:27administrative units , nor does it alter

22:30the structure or duties of the

22:33municipal public administration bodies .

22:56aims to establish guidelines for

23:12on the constitutional principles of

23:16human dignity . Equality is not

23:19discrimination , as well as Federal Law

23:21number 13.146 / 2015 , 146/2015 , Brazilian

23:26Law for the Inclusion of Persons with

23:29Disabilities , which ensures the right

23:31to accessibility and full participation

23:33in society for people with disabilities

23:36. The matter is of evident local

23:40interest , seeking to strengthen a

23:42culture of respect , inclusion , and the

23:44elimination of barriers that hinder the

23:46participation of people with

23:48disabilities at the municipal level . It

23:52is highlighted that the proposal was

23:55drafted so as not to create public

23:58positions , agencies , or functions , not

24:01to alter the municipality's

24:03administrative structure , not to

24:05determine the hiring of civil servants ,

24:08and not to impose specific expenses ,

24:11thus preserving the Executive Branch's

24:14autonomy . Actions eventually resulting

24:18from this law must observe budgetary

24:21and financial availability and may be

24:23integrated into the municipality's

24:26already existing activities . Thus , the

24:30project establishes only general

24:33guidelines of public interest , without

24:36interfering with the executive's

24:39administrative organization , seeking to

24:42contribute to a more accessible ,

24:45inclusive , and egalitarian Biritiba

24:51the matter and its compatibility . With

27:06Jardim Vista Alegre neighborhood , which

27:09currently has potholes in the pavement

27:13and deficient public lighting ,

27:15compromising safety and the proper

27:18movement of pedestrians , residents , and

27:21vehicles . As reported by the public ,

27:27the poor conditions of the road have

27:30already caused risky situations ,

27:33including a report of a resident who

27:36twisted her ankle while walking due to

27:39irregularities in the pavement . The

27:45lack of adequate lighting further

27:47aggravates the problem , especially at

27:50night , making it difficult to see

27:52obstacles and increasing the risk of

27:55falls and accidents . Maintaining public

28:01roads and the lighting system are

28:03essential measures to ensure adequate

28:06mobility , accessibility , and safety for

28:09the citizens . Therefore , it is

28:13necessary for the executive branch to

28:16take urgent measures to solve the

28:21pointed-out problems and ensure better

28:24conditions for residents of the region .

28:28It is highlighted that the present

28:30request is supported by Article 37 ,

28:34paragraph 2 of the Organic Law of the

28:37Municipality , as well as Articles 269

28:40and 271 of the Internal Regulations ,

28:46which ensures the councilman's right to

28:49oversee and request information from

28:52the executive branch on matters of

28:54public interest . Following the standard

28:58adopted in requests from this house .

29:25Mr. President , fellow councilmen ,

29:26talking about public lighting has

29:28become something labeled here in the

29:30Chamber , routine . If we look at today's

29:33agenda , there are already five items

29:36regarding public lighting . It’s

29:40stating the obvious to say that public

29:42lighting and public safety go hand in

29:43hand , Mr. President . And even more so

29:46in this case , it’s a health issue ,

29:47because the woman fell , twisted her

29:49ankle , ended up fracturing it , and God

29:50knows how long it will take her to

29:52recover . And what surprises me the most

29:57when we talk about public lighting , Mr.

29:59President , is learning about a bid , or

30:02rather , a bidding waiver process in the

30:05amount of R $ 125,000 to find out where

30:07the burnt-out light bulbs are in this

30:10city . Mr. President , every council

30:13member , whether supporting the mayor or

30:15not , makes requests for public lighting

30:17every single week . There are public

30:20lighting requests here for right in

30:22front of City Hall . We had an 18 -

30:25million-real bid to solve the lighting

30:27problem . An extremely expensive bid ,

30:29nearly 10 % of the city's budget , which

30:31was canceled because the Court of

30:33Accounts questioned the amount . And

30:36then , with all these problems , we have

30:39a bidding waiver in the amount of R $

30:41125,000 just to know where the lights

30:43are burnt out . It basically means

30:47thinking the taxpayer is a fool , Mr.

30:49President , or that our recommendations

30:50aren't reaching the mayor . Our

30:52recommendations , our requests , because

30:55it's very simple . If you look back over

30:58the years , because this isn't something

31:00just , uh , commonplace , Mr. President ,

31:02it's routine . There are public lighting

31:06requests here that are years old .

31:09Public lighting requests , and Council

31:17piles of requests , whether formal

33:10clarifications regarding the pothole

33:12existing in the asphalt pavement of Rua

33:14Campo Sales , in the Jardim Vista Alegre

33:16neighborhood , near number 90 . First , is

33:21the executive branch aware of said

33:23pothole and the possible existence of a

33:26void or compromise to the base located

33:28beneath the asphalt pavement , which has

33:30been causing concern among residents ?

33:35Second , is there a scheduled timeframe

33:37for conducting a technical inspection

34:04road users ? This request is justified

34:10by the complaints forwarded by local

34:13residents who contacted this councilman

34:16, reporting the existence of a deep

34:18pothole in the asphalt near number 90 ,

34:21showing signs that the area located

34:24below the pavement is hollow . It

34:29deserves immediate attention , since the

34:32apparent compromise of the structure

34:35beneath the asphalt layer could cause

34:38the opening to increase , lead to

34:41pavement subsidence , or even its

34:43collapse , putting vehicles ,

34:45motorcyclists , cyclists , and

34:48pedestrians who pass through the

34:50location daily at risk . In addition to

34:55the risk of accidents , the delay in

34:58intervention contributes to the

35:00worsening of the problems , especially

35:03during the rainy season , when water

35:05infiltration can cause greater soil

35:08erosion and expand the cavity beneath

35:10the asphalt , subsequently making the

35:14repair more complex and costly to the

35:16public coffers . Given this , it is

35:26essential to conduct an urgent

35:29technical inspection , followed by the

35:32proper recovery of the road structure ,

35:35not limited only to the superficial

35:37closing of the pothole , but ensuring

35:40that any compromise of the base is duly

35:43corrected , providing safety and

35:46stability to the pavement . This request

35:52is supported by Article 37 , item 2 ,

35:54paragraph A , of the Municipal Organic

35:56Law , as well as by Articles 269 and 271

35:59, item 2 , paragraph A , of the Internal

36:01Regulations , which ensure the

36:03councilman the right to oversee and

36:06request information from the Executive

36:08Branch on matters of public interest ,

36:11following the standard adopted for

36:13requests from this House . Having

36:17nothing further for the moment , I take
