3:19start out by introducing uh our new
3:22trustes. As you can see, we have a whole
3:24board now. Kelly Randle,

3:35I also want, as you see in front, we
3:37have a new um digital system. It's
3:39called the Owl. What we're going to be
3:41doing is recording, videotaping. We have
3:44the technology to live stream as well.
3:46Tonight we're not going to live stream.
3:48We got to work out a few bugs. But I'm
3:50hoping by next week we can do that. By
3:51tonight we are recording with it and
3:53taking the video. It'll be available on
3:57YouTube, I believe. Is that correct,

4:37Audrey Dunning, they'll be speaking
4:39tonight about uh the Village Court and
4:43uh um shared services consolidation with
4:46the town. We have uh Her County Land
4:49Bank here and we have Don Hall who
4:52talking about uh our project.
4:58All right. Before we get started um on
5:00the mayor's comments, I just want to let
5:02everybody know that um I'm going to
5:05strictly adhere to the uh policy that is
5:08in place. Um the 3 minute 3 minute I
5:12believe is what we have. Um
5:16and that's it. It's not going to be any
5:18dialogue back and forth. No questions
5:20answered. Um if if any elected official
5:23trust me want to answer a a question,
5:26>> we'll do three. immigration is free.
5:28Everybody's good with that. Um, but that
5:30that's this is not a public hearing. Uh,
5:33public hearing will be coming up once we
5:35um move uh our agenda to a local law and
5:40we haven't done that opportunity where
5:42we'll have much more discussion back and
5:44forth.
5:46All right. So,
5:49request for appearance. Um, Judge Stone,
5:52go to court.
5:58Good evening. Good morning, Mayor. So,
6:01um, Miss Dunning has, um, been planned
6:04that she has, uh, res, uh, resigned and
6:07she will be resigning effective the 30th
6:08of September. I have been the associate
6:12village justice here since 2012.
6:15Um, and um, basically what we're looking
6:19to do is I'm looking to, if this board
6:22wishes, to appoint me to her position,
6:26uh, vacate my position and just address
6:30the court clerk's pay um, until the end
6:34of the fiscal year, which would be May
6:3731st. Um, so we're looking to take care
6:39of her pay. She's um super qualified,
6:43does an absolute great job, and she
6:44just, in my opinion, she's underpaid. I
6:47mean, I think she makes almost minimum
6:48wage, and uh I could be wrong on 50 or
6:5160 cents on that, but uh um
6:53[clears throat] she's worth it. And uh
6:55so the train, so if that was to take
6:57place, I appreciate that. It would save
6:59the village roughly around $4,000 on on
7:02an annual basis. So only probably uh a
7:05little more than half of that uh till
7:07the end of May 31st. Um the plan would
7:10be um Gillian is the last village um in
7:13the county to have a village court. So
7:16the town of German Flats, we've been
7:18preparing for this. We really haven't um
7:21had any board contact like this
7:23whatsoever. We've had some individual
7:24conversations with uh previous
7:26administration, but no um public talks
7:30of anything because we really didn't
7:31know what what we were going to do and
7:33we obviously weren't going to do
7:34anything until there was a new board
7:35here and now there's a new board. So,
7:38what I would recommend um is to have the
7:42board follow the controllers uh uh the
7:45controllers's office line of to make a
7:48resolution to um dissolve the village
7:51court. Um that would have to go up for a
7:54um public hearing um after a certain
7:57amount of time. And if there's no public
7:59referendum. If there's no u people
8:01against it, we're going to go out and
8:02get signatures against it the court um
8:05then we would go forward and we would
8:07transition um into the town of German
8:09flights court. And that gets rid of the
8:11liability of of everything to do with
8:13the court except for the court records.
8:16And that will bring me to the other I
8:18think it's on your resolution for you
8:19tonight where I'm looking for a grant.
8:22not going to spend $30,000. Up to
8:24$30,000 for us to apply for a grant from
8:28they call it JCAP from the state of New
8:30York. And if they approve that up to
8:33$30,000, the years and years of records
8:36we have here and boxes and boxes of
8:38stuff that below in that cellar below
8:40over there below the police station
8:42would be uh digitalized and put to um
8:46transfer basically to German flats as
8:48soon as that happens. So basically the
8:51the village clerk would be the custodian
8:53of those files, but if they're all
8:54digitalized, she wouldn't have to be the
8:56custodian of them. Just I I was also the
8:58village justice and associate village
9:01justice in the village hurt for the past
9:03four and a half years and we went
9:04through the transition of closing the
9:05court on June 30th. Um they did things a
9:08little different over there. They did it
9:10kind of aggressively and fast. Um, I'm
9:12hoping to have the 8 months, 9 months to
9:15just um transition so the people of the
9:18village people understand people who get
9:20ticketed or arrested in this town or um
9:23any kind of violation, they have ample
9:26time to uh transition over to German
9:28flats and to make it smooth. If you've
9:30been here on any court day, I was here
9:32on Friday. Obviously, judge was too. And
9:34uh I mean they're just everywhere. I
9:35mean, and and that's one thing that I
9:37want to and I'm not looking to waste
9:38everyone's time. I want to answer a few
9:40questions. So the village might seem
9:42like why is the court not making all
9:43this money with everyone there? Well,
9:46the money comes in and the money goes to
9:48the state and they distribute it how
9:50they feel fit with a form a formula. But
9:53any criminal matter money barely
9:55anything less less than 5% comes back to
9:57the village. Now some vehicle and
9:59traffic monies get reduced they come
10:01back to the village. But that's not what
10:03I should be talking about or the court's
10:05about. The court's about justice and
10:07that's why we we try to do it that way.
10:09So, um, over the past years, if you look
10:12at the budgets, Illyn has not, I don't
10:14think they've ever made money in the
10:15past, especially since I've been here.
10:17They don't, it was not wasn't a money
10:18maker. It's pretty much a liability. Um,
10:21we're the last village in the town in
10:22the in the county to have one. Um, when
10:24I got into elected in 2012, Mohawk
10:27merged with German Flight Sten. Um, like
10:30I said, Herman Murders did, Dodgeville
10:32did years back, and um, Middleville did
10:36about six, seven years ago also. So, I'm
10:38I'm very familiar with the process and
10:40um it should be a very smooth transition
10:43and if anyone has any questions, they
10:44can let me know. Currently, all
10:46evictions have been done in German flats
10:48since I got elected in 2012. So, there
10:51have never been an eviction here unless
10:52I had a conflict with some with someone
10:55and then it was done. He went to do it.
10:57But, I don't think we ever had that
10:58conflict once. He only judge Kip by one
11:00time had to do one for me. uh besides
11:02that and those conflicts just get pushed
11:04out to other towns if they if they
11:06happen. So there'll be no conflict with
11:08that. So um so that's what we're looking
11:11to do. So, I'm looking I'm asking the
11:13board to um um approve
11:18Miss Dunnian's resignation appoint me
11:20and as the would be the village justice
11:24um and there would be no need for a new
11:25election because the controllers's
11:27office states that as long as the board
11:30votes within 90 days of um Miss Dunny's
11:34resignation that there's no reason to
11:36have a special election or any kind of
11:37election and the election would be next
11:39June if you decided not to go forward.
11:42So, um I could sit until next June and
11:44then we just can have an election if the
11:46board votes not to go forward with a
11:49merger with the counter defense.
11:51>> I would like to add one point.
11:52>> Yeah,
11:54I'd like to add one point because this
11:56is something that I have firsthand
11:58knowledge of.
11:59Our court went through because we get
12:02audited on several fronts.
12:04um our audit with the state
12:06controllers's office two months ago and
12:11we have very limited work hours for our
12:14clerk here in the village. They have
12:16denied multiple requests over the years.
12:20Not this board, not this mayor for extra
12:23hours
12:24um for extra money that's needed to
12:27properly run our court because the
12:29village of court by and large is a
12:32criminal court. We don't get the volume
12:35of traffic cases even though people know
12:37there's a lot of traffic tickets. Most
12:40of our volume is criminal which is why
12:42there's a lot less money that comes in.
12:45However, the controllers's office has
12:47told us because of the state mandates
12:50for um operational matters that we have
12:53to put in place for we have to go back
12:56through however many years of records to
12:58meet their new recordeping requirements.
13:01that they could in fact that's what they
13:03told us make the village increase the
13:06clerk's hours give us the financial
13:09resources we need to do what we need to
13:11do so this is a big expense that the
13:14village will be looking at not to
13:18mention the fact that a recent safety
13:19audit here in the village exposed a
13:22number of safety concerns in our court
13:26those would need to be addressed
13:29and that again is another matter that
13:33would be at least in the tens of
13:36thousands of dollars if not more to
13:40address and correct in our courtroom. We
13:42have had numerous outbursts in our
13:44courtroom, people taken out in
13:46handcuffs.
13:48That's the joy of having a largely
13:49criminal calendar. So, there are other
13:52expenses beyond the salary and our
13:54budget that are looming on the horizon
13:58if this merger does not occur. So I just
14:01want to make sure that you understood
14:03that the finances are the savings to the
14:06village are more significant than you
14:09know it appears right now.

14:15>> May I ask Judge Dunn
14:18um you've been at this a long time. You
14:21too, Judge Stone. I'd like to hear and
14:23I'd like the people in the room to hear
14:26your view on whether you think on
14:29balance for the people who live in
14:31Illiam is this consolidation a good
14:35thing
14:37>> 100% yes
14:41>> well I on all aspects for me financially
14:43for the village for the taxpayers I
14:45absolutely 100% agree is it an
14:47inconvenience for someone who lives on
14:49southb to go to terminal flats to answer
14:53a speeding ticket. I mean, it could be,
14:55but all in all, it's it's to me it's
14:57it's it's in the best interest of the
14:58village to do that. We do not have like
15:02judge, we do not have enough time like
15:05this this court has it might not be
15:08busier than Burkmer, but it's really
15:09close. I mean, when it comes to it
15:11wasn't for Walmart having all those
15:12purses over there, it we would be
15:14busier. We have we have a PD who um it
15:18seems like they're just they're on the
15:20ball here. It seems like we have a lot
15:21of arrest, but when you go to places who
15:23don't have a lot of a lot of lot of
15:25places that don't have cops and don't
15:26have um we we see a lot more problems
15:29coming, you know, I think you see that
15:31on the outskirts of towns, especially in
15:33Frankfurt towards Udica and stuff, it's
15:34really it's coming this way. And uh I
15:37think that um you know I just for me I'm
15:41not easy I'm not saying she is but when
15:42it comes to to to to people coming to
15:45our town who don't belong here and
15:47stealing and doing crimes here I'm not
15:49an easy person when it comes to it and
15:51uh neither has been Judge Dunn. But uh
15:54and I just think that we're getting
15:55better. Our court is um it was so busy
15:59at one point just because we had so much
16:00but I just think we're getting people to
16:02understand you want to commit a crime in
16:04the village of building you're going to
16:05pay for it when it comes to the at the
16:07court level. So I believe I really do to
16:09answer your question I think this is the
16:11best move for the village. I have lived
16:13I grew up here all my life. um things
16:15have changed um drastically um over time
16:18and uh but I do believe this is the best
16:21thing and the biggest inconvenience is
16:22that someone living you know somewhere
16:26doesn't have you know we have um German
16:27flats has two elected judges one lives
16:29in Illen um I live in German flats
16:31outside and um that's the anger so he'll
16:35also he'll also be there so there's two
16:37people that the village of people elect
16:39so it's you know so it's just like
16:41German flats moian they all elect us you
16:43know we're up every four years. So, they
16:45have their choice and uh that's I do
16:47believe that's the uh the correct way to
16:48go.

16:49>> And and I will I will just add in the
16:51last 3 years, four years, our case load
16:56has more than doubled in our court. More
16:59than double. Yeah. We've got the numbers
17:01to prove it. This and the state
17:03recognizes that. That's why they're
17:05talking about more resources for the
17:07court because everything gets reported
17:09up the food chain. And here in Illen,
17:12because of our large criminal calendar,
17:15and this started before I was on the
17:17bench, I believe all civil matters,
17:20which means evictions and small claims
17:22have been done by the associate judge.
17:25Most of them over in the German flag.
17:27>> I just take them over to German flats.
17:28That's how I've done it for years. I
17:29just do everything there. So, everyone
17:31knows if you get an eviction, you go
17:32there, right?
17:33>> And that's how I've done it for years.
17:34>> Because we do not have the time or the
17:37manpower to handle it. Um I it there
17:41will be the same number of court
17:42sessions. Some of them may even be at a
17:45more convenient time for people that
17:47live in the village. But I I see no
17:49downside to this merger. And just to
17:52give you a So there's about 80 to 90
17:55people in our county jail. I would
17:58average that 25 26 27 are out of the
18:02building. So, and the and the and the
18:05other and the other third is out of the
18:08is out of the building and the other
18:09third is the rest of the county. So,
18:11that just shows you what's I mean, it
18:13really does. That's what's happening.
18:15But, you know, it's not, you know, we
18:16get our serious ones, but it's just a
18:18lot of, you know, you know, we have two
18:20problem, we have two major problems. We
18:22have mental health, we have addiction.
18:24And if people understand addiction,
18:26understand mental health, we know what
18:27it is. If they don't, then, you know,
18:29that's what happens. And this is what,
18:31you know, where I'm trying to do in
18:32German Flats, and I've done it over
18:33there successfully. And if we can do it
18:35over here is that that 18, 19year-old
18:38young man or young woman who gets in
18:40trouble in town, I would rather have
18:41them be assigned to go clean the village
18:44own parking lot if if it could happen um
18:46over by the Dollar General or whatever.
18:48They can sweep the parking lot for us
18:50and uh instead of paying that $200 fine
18:52that's going to the state where I
18:54wouldn't want to have the 10 time
18:55convicted drug person or petted arson
18:57person um cleaning up next to people's
19:00cars in town. I would not rather have
19:01that person. that's not the right job
19:03for that person or the right outcome for
19:04that. So that's how I want to go forward
19:08and it works and we can work on
19:10community service type things going
19:12forward. I would love to do that. I just
19:14know that as soon as I assign that then
19:16we have to have someone supervised and
19:17be responsible. So there's a lot to
19:19that. So I'm just not sure if that can
19:20happen with the village we have the
19:21manpower or the or the time in the
19:23organization to do that. So, uh
19:25something in the future that we can work
19:26on if that's someone who can find a
19:29program and a supervisor for that.
19:32>> Anything else?
19:33>> I do, mayor, if I could. Um for
19:35budgetary purposes, um would the village
19:38if it was to move to the town or um
19:40would we still have budgetary expenses?
19:42>> So, we are the town is responsible just
19:45like if you poof the village um town
19:48would be responsible except for you know
19:51there's certain things you would need.
19:52But when it comes to the village court,
19:54I'll answer your question. There's no
19:55other fees. There's no uh we we
19:58basically pay you just like the village
19:59of Mohawk. If you get a parking ticket
20:01in the village of Mohawk, you pay the
20:03court to Germans. Quarterly, we send you
20:06a check. If we get a codes fine from the
20:09village of Mohawk for a $200 fine, we
20:12will send you that check and that
20:14quarterly. And we do that for Milwaukee
20:16every uh we never used to do that. The
20:18Mohawk's attorney who was our attorney
20:20kind of said we're not doing things
20:21right. So we've been sending checks for
20:23the past uh six seven years but so
20:25whatever we collect on behalf of any
20:27local law or any codes case um will go
20:31directly back to the village on
20:32quarterly and our books are always open
20:34for inspection when it comes to that if
20:36someone ever wanted to come over and
20:37look to see if um you know they're
20:39actually getting their fair [laughter]
20:40share um parking ticket things the only
20:42thing I think we have to talk about um
20:44with the state going forward I believe
20:47you can keep your parking tickets here
20:49and accept your money just how you do it
20:50now I'm hoping that's the case because
20:53it seems like a lot of work. Um, but at
20:55least you didn't keep your money. But I
20:56don't know. I'm not I don't have that
20:58answer. So that's the only answer they
20:59got to find out. So

21:02>> So the village of Herkimer still takes
21:05their their parking tax and collects
21:07their fines. Okay. Village of Mohawk
21:10does not. Um, village of Middleville
21:13does keeps their fine. So it's it's all
21:16over the board. I just don't know. I'm
21:18assuming that Burton's doing it. it's
21:19not uh illegal to keep going. So, but uh
21:22that's the only thing you have. And then
21:24just so you know, Vanessa, the woman who
21:25works for us as the clerk, um I got a
21:28verbal from the German flats board um
21:30that uh they're going to bring her on um
21:33at the going rate that she will be
21:35making hopefully efforts.
21:36[clears throat] So, the town will take
21:37over
21:38>> the town will take over. They'll take
21:39over her part-time salary. Yep. And then
21:42um the three salaries and also the
21:46assistant district attorney's salary. I
21:47believe it's $4,000. that would also be
21:50to taken care of by the towns.
21:52>> Okay. So, we wouldn't have anything here
21:54for budgetary wise.
21:55>> We have you would have no budget for for
21:57your June 1st going forward. So, um I as
22:00like all I really ask is that May 31st
22:02if we can get Vanessa or the clerk that
22:05few extra dollars I asked for in the
22:06letter to the board. Um I would
22:08appreciate that. I think she's well
22:10worth it and she's been well welld
22:11deserved in time that she really she
22:14got. So, I appreciate that.

22:24um budgetary need that.
22:28>> So no budgetary need from June as long
22:30as we agree that the date is going to be
22:31we're going to vote soon and we're going
22:33to do May 31st, 2027. That we'll go
22:37forward and we will um your board can
22:40work with our board and making sure
22:41everything's done. um when it comes
22:44there there's someone from the
22:44controllers's office that will more than
22:46gladly help us. I will I will ask one
22:48thing that next year that if I if I'm
22:51able to apply for a joint grant to help
22:55so basically and instead of applying for
22:5730,000 we can apply for 60,000 and that
22:59joint grant that comes from state money
23:01that could be used towards the
23:03construction um and the rehab of the
23:06current German flags court. So, we're
23:08trying to make a separate entrance total
23:10so when you go pay your taxes, you don't
23:12have the same person sitting next to
23:14someone, you know, so someone can walk
23:15in and pay their taxes without having um
23:1830 people sitting next to them. So, just
23:20just to give you like someday here in
23:22court, she's had up to 17 um defendants,
23:26inmates, infendants, whatever you want
23:28to call them, but in court at one time,
23:30that's 17 in one time. That's half the
23:33size of the court. So, that just shows
23:35you sometime what what we get. So, we
23:37need to make room over there. German
23:38flats, we applied for a grant over
23:39there. We've received over 30,000 to
23:42make it um handicap accessible, all the
23:44power doors. So, that's all done over
23:46there. Uh we just need to make the um
23:48the new improvements for parking, which
23:50there's going to it's going to be a
23:51problem next year. There's going to be a
23:52problem for a few months until until we
23:54get everything under control. But, uh
23:56that's that. Not all the court um
23:59besides the gray chairs in the
24:00courtroom, a few desks, the computers
24:02and the printers that is court that'll
24:04be the unified court system. Um they
24:07will come and take what what's theirs
24:09and the chairs will go to German flats
24:11if that's okay and everything else will
24:14stay and um there's no I've tried to
24:17figure out there's no way we can keep
24:19the village court to have a trial or
24:21something cuz I court looks more like a
24:23courtroom than German flats. But uh um I
24:25was told uh soon as you move it, that's
24:28where you are. So there will be no So
24:29that room will be for whatever you see
24:32fit to do. Obviously um you know, right
24:35now we're not handicapped accessible. I
24:36don't believe
24:37>> no the witness boxes and the juror box
24:40isn't I mean let alone for you know you
24:43know people to enter and get in the
24:45courtroom. Um then there's no way to do
24:48it. We've looked into it a couple of
24:50times here since I've been on the bench
24:53and it's six figures um easily to make
24:56that area um fully handicap accessible
25:00ADA compliant. You can't it's just
25:02impossible.
25:03>> And one last question if I may. So would
25:05we have to there banning expense on the
25:08village for um port security or
25:10>> No, I mean I mean by by No. I mean your
25:13responsibility um of those 4 hours of
25:15overtime um are probably no longer uh
25:19your responsibility. Um you know would I
25:22ask if you had you know if we could work
25:24something out with with you know I'm not
25:26sure if we could work something out with
25:27the an offduty officer or whatever. We
25:30do that right now with Mohawk. They just
25:32seem not to have any staff that's any
25:34interested in doing it. Um, but we we
25:36need we we need to address that and
25:38we're going to address that. We can't
25:39ask the village to uh even though I want
25:42to, we can't ask the village to supply
25:44someone. I don't think they have
25:45jurisdiction over there. There's just a
25:47lot to it. So, I really don't if he gets
25:49hurt on the job over there. It's not
25:50jurisdiction. So, I I just don't uh I
25:52don't think we should go down that road.
25:54I think we should just um let German
25:56flats figure it out um instead of just a
25:58million taxpayers paying for 4 hours of
26:00overtime to sit in German flats. So, I'm
26:03trying to give you the answer I think
26:04you want. Um but I just don't think that
26:06um that the board after looking at it
26:08would go for it and I'm not sure if the
26:10police department would go for it
26:11either. I just I don't know how that
26:12would work out. So, so I think that
26:14we're going to fend for ourselves over
26:15there and

26:25decrease in liability, and increased
26:27efficiency.
26:28>> Absolutely. Yep. 100%. And the only last
26:30thing I had to say is not pertaining to
26:32the court, but um it it bothers me when
26:36I when I have these codes cases out in
26:38German Flats and uh twice a year German
26:41Flats has a garbage day. And some people
26:43in the village of I might realize they
26:45pay German flats taxes. So take
26:46advantage of it if you can. Um, there's
26:48a place you can go sign up at the
26:50village at the town, excuse me, for
26:52garbage day. So, if you have people who
26:54are not in compliance with garbage and
26:57you'd like to give them a nudge to say,
26:58"Listen, you have a chance to go on
27:00October 14th or whatever day. I'm not
27:01sure what day. I think it's that
27:03weekend. It's coming up." But that
27:05weekend to bring your trash, not not
27:07garbage garbage, but your your debris
27:09over to the town of German flats. As
27:12long as you have a permit, which they'll
27:13give to you for free, you can bring that
27:15over. So for the codes officer to know
27:16that I can't tell them what to do. I'm
27:18just trying to remind everybody that we
27:20have these every year and then we have
27:21then two weeks later we'll get all these
27:23violations or people having garbage out
27:25front or debris. Just uh so hopefully
27:28the people that do have those can get
27:29that reminder that they can do that and
27:31no charge. Um and that's it. That's it.

28:04whereas the bill is really important to
28:06digitally scan all past documents and
28:08whereas the billing board endorses
28:11practices that provide security safety
28:13and efficiency and whereas an
28:15application has been prepared for funds
28:17to address these needs through the New
28:19York State Office support administration
28:21program and be a firm result of the
28:23Philadelphiaian board authorizes the
28:26Philadelphiaian court to apply for a

33:27I had a meeting with the mayor uh with
33:29the county. What was your name?

33:35our county. Background. Uh our county
33:37was part of a uh multi-county land bank
33:40and they chose to get out of it in 2020,
33:43I believe, because uh they things
33:46weren't getting done. So they uh in 2024
33:49they opted to form their own land bank.
33:52and I'm at uh you know I run it just one
33:55employee so it's kind of they keep their
33:58thumb on me so and that's the way it
34:01should be you know you can really focus
34:03and get things done so
34:06with that I meeting with towns villages
34:09and I've met with the mayor like I said
34:12and uh the county treasurer who's also
34:14the treasure of the land bank um Cindy
34:18Bennett was there county legislator uh
34:21we discussed test uh some of the zombie
34:24properties in the villa villian. Um
34:27that's what we do. We're trying to clean
34:28up planted properties, abandoned
34:30properties, either get them demolished
34:33or rehabilitated and back on the tax
34:35roles one way or another. Uh the great
34:38thing about the land bank program is uh
34:41we attach a development enforcement
34:43mortgage to any property that we can
34:45sell and in that it kind of keeps our
34:48thumb on it. They have 12 months to do
34:51it. They can apply for a onetime
34:5312-month extension. Um, we've got a
34:56couple projects. There's actually
35:01a few projects going on right now in the
35:03village.
35:07Um, we have nine properties that we took
35:10so far in the two years that we've been
35:12operating. Uh, we demolished one tending
35:15place. I don't know if anyone's familiar
35:17with it, but it was a dilapitated house.
35:20It had to come down. Um
35:23uh we've sold five properties um um to
35:27different people. Uh some of them people
35:29would think they' never be able to be
35:31fixed and they can be fixed. I mean,
35:33anything can be fixed. It's just how
35:34deep you want to go to fix it. Um so,
35:38but the the the nice thing about the
35:40program is like uh we got one over here
35:42on 26 Clark Street.
35:46um whole foundation wall was kicked in.
35:48It was kind of a mess. All the windows
35:50were getting busted out of it. We sold
35:52it for $5,000. The guy's fixing it up.
35:55He's got a year to two years to fix it
35:58up and get it back to code's compliant.
36:00We require a certificate of compliance
36:03or occupancy before we sign off on it to
36:08the the person, the developer, whoever
36:10it is. If they choose uh someone wants a
36:13property next door that to be
36:14demolished, that could be it could be
36:15demolished as well. Doesn't have to be
36:17re rehabilitated. It can be demolished.
36:20But again, they have to demolish it,
36:22clean up the property, seed it.
36:27That's what we do. Uh we met with the
36:29mayor about and uh Cindy had asked me to
36:32come. Um,
36:34zombie properties. Zombie properties are
36:36properties that the county didn't take
36:38because of whatever issues, mostly codes
36:41issues, codes problems. Um, so the
36:43county doesn't take them. They kind of
36:45float. Nobody's paying taxes on them.
36:48They actually the owner still is the
36:50owner of the property. Um, and there's I
36:54think there's 90 of them in the county
36:56right now and there's several in the
36:57village.
36:59Um, trying to address those. We have
37:01some money left over for this current
37:03grant cycle for demolitions and we'd
37:06like to do at least two more maybe three
37:10up to four in the village. Um I had a
37:14list given to me from I don't know from
37:17the village or Cindy but uh a list of
37:20properties they weeded it down to four
37:23properties. I don't know if you the
37:24board seen this stuff or not. I don't
37:26think we collect
37:29yet.

37:59properties, uh the situation with zombie
38:02properties and the way we're handling it
38:04is if uh there's only three ways that I
38:06know they get the properties. Maybe JK
38:09or somebody knows different, but
38:11property owner turns the property over
38:13to you or the land bank county can take
38:16from tax foreclosure proceedings. takes
38:18about 3 years to get the property
38:20through that system or the municipality
38:23can take it through an article 19
38:24proceeding which is a court proceeding
38:26in supreme court.
38:28So, if you want to move forward on these
38:30properties, that route, which is the the
38:33quickest route, is either to have the
38:35property owner turn it over to you. The
38:37village wants to attempt to do that,
38:38that would be great, and they would do
38:40it. Easiest way. They're signed over.
38:43You get title to it, hand it to the
38:45land, we'll demolish the property, clean
38:47it up. Um, the second second fastest way
38:51is article 19 proceeding, which uh
38:55specific steps to go with that. And I
38:57don't know, I love the the procedures
39:00with the bear. So, if anybody needs any
39:02information, you can contact me or get a
39:05hold of uh you know, through the there's
39:06a website. Just email me and I'll I'll
39:09get back to you.

39:42responsibility, but everything else
39:46could work. You know, it it should help
39:48to benefit the communities.
39:51It's a great program along with uh what
39:54we're doing with CDBG grants

40:03think that we're aggressively pursuing
40:06designing properties fractions whatever.
40:09I think working together is going to be
40:11a major bill. My background is coach.
40:14Coach is big. I mean and nobody wants to
40:16be the bad guy but I always approach
40:18you're not the bad guy. You're just
40:20trying to, you know, you try and work
40:22with people as best you can to try and
40:24get them to realize that, hey, you clean
40:26up your property. It's benefiting
40:27everyone around.

43:01to if we're in agreement that we're
43:03going to potentially take this property,
43:06I have to get the county to say they're
43:08going to be in agreement to forgive the
43:09taxes and then then it starts to move.
43:13Uh but once that happens, I come back to
43:15you and say it's a go
43:18and get titles to the property and we'll
43:20then turn it over to the life bank. We
43:22could do an agreement,

43:28that there are a number of these
43:31properties that the county just removes
43:34from the tax roles. They don't even tell
43:36us.

44:42to legally go through and secure a
44:45property or agreement the first step is
44:48to get me a list of your wishes and then
44:52I'll take it to the county and say
44:55or my board first and say, "Hey, LA's
44:57got these eight properties." And they're
44:59going to say, "Well, let's do four of
45:00them." And then I go to the county and
45:04say, "Will you re, you know,
45:06forgive the taxes on these four
45:08properties? We're going to work with the
45:09village to tear them down. And then I
45:12come back to the village and say, "It's
45:14a go with the county. If I can get a
45:16written agreement with you folks, we'll
45:18do it. You move forward on your end. the
45:20properties turning.
45:23We'll turn them down.

46:19foregoes a bunch of things. If we're
46:22going to rehab the property different
46:24ball game you have my testing which is
46:27asbestous lead and contaminants which is
46:31costly and a pain. Um we did we've done
46:35two so far, one in one for one, one in
46:38low falls. Um remediation for one was
46:42$65,000. Remediation for the other was
46:45$35,000.

47:58the existing Jersey curve wall was
48:02straddling the property line, but we
48:04didn't know for sure that the reports
48:07that we we received during demolition
48:09were that it's you know there was a pin
48:12there, but it's gone now and certain
48:14things got moved on the HSA side. So
48:16bottom line is we need to know for
48:19purposes of the grant JK um exactly
48:22where that line is on the uh on the
48:25north side and on the east side. So you
48:28asked me to put together
48:31request for proposals for those. I I did
48:34that and we received one proposal and
48:38that was from Emer surveying out of
48:41Illen. There were six or seven.
48:45Let's see. 1 2 3 4 five total. I had
48:49seven people on the list. Five of them
48:51responded and they basically said, "See
48:53you in April." Um, so Mike did submit a
48:58proposal and the proposal is not to
49:00exceed $1,500 and do this work quickly.
49:05my concern um and I asked him to define
49:08quickly and he said I probably can get
49:10it done before first week in October if
49:13you need it to close out this grant and
49:15the answer to that is yes we do. So, we
49:18have to get the survey done. Then I've
49:20got Nelson Associates out of Clinton
49:23um BNL and also
49:28Boulder Consulting. Rhy
49:32Harper putting proposals in for the
49:34engineering. We just need the footing uh
49:36the basic footing once we know the
49:39location and then the specs for the wall
49:41itself and but we need that to have a PE
49:44stamp on. So that's the next step for

52:14guys. My name is Lynn August. I retired
52:18from state service in 2023 after 24
52:21years of combined service in different
52:22agencies. After retirement, all I wanted
52:25to do was return to this area and live
52:27out my life in peace. My new home is
52:30exactly 1.2 miles from the former
52:32Remington Arms site where Turan has
52:34proposed an AI data center that would
52:37ruin the community. Hours before the
52:39last board meeting, there was a drastic
52:41change in public commenting, limiting
52:43residents to two minutes and time by an
52:45associate from the appointed village
52:46attorney. However, JK was allowed to
52:50speak for over 20 minutes in an attempt
52:52to confuse the public and justify the
52:5412-page document/moratorium,
52:58which when stripped down to his
52:59essential provision simply pauses any
53:01development that requires more than 2
53:04megawatts of power from the IMEU.
53:07His document does not place a moratorium
53:10on any development containing
53:11electricity directly from an alternate
53:14provider such as the NYPA, National Grid
53:17or the or by generated electricity from
53:20an on-site gas turbine or micronuclear
53:23reactor.
53:25If this board or the village attorney
53:27actually did any research, they would
53:28know that these are the newest power
53:30sources for AI data centers to avoid
53:33grid delays.
53:35So they want to bypass the electrical
53:37grids. Attorney Hay was given a draft of
53:40a successful moratorum proposal used by
53:43Dryen New York. Another community faced
53:46with the same prospect of a data set.
53:48None of that content was utilized.
53:51Instead, we were given a different
53:52document [laughter] that gives nothing
53:53to nothing to the community.
53:56The the village deserves a date for a
53:59public hearing and we want that to
54:02happen before any decision is voted on
54:04regarding the moratorum so that the
54:06people can have their say.
54:09The moratorum should be in place before
54:12any meeting with Turin LLC with
54:15protections for our health, welfare,
54:18precious resources and updated village
54:21zoning laws to protect future
54:24generations.
54:26Attorney Hay is functioning at the
54:28county level as an electrical consultant
54:30for the application by Turan LLC.
54:34Why is this not a conflict of interest?
54:38I think it's important to thoroughly
54:40research the actions and payments to
54:41Hagen Hag LLC, where they came from, and
54:44the amounts that his services are
54:46costing the village. information that is
54:48not transparent,
54:51but buried across numerous websites and
54:54oil oil attempts are being delayed.
54:57I say every resident should be able to
55:00see what they're getting for their
55:02outrageous taxes.

56:00thoughts that I had because we have new
56:02people and a new board and um, we've had
56:05a lot of things that we've talked about
56:07with the data center and different
56:08things going on within the village and I
56:11just wanted to, you know, sort of review
56:12our our thoughts and things that uh, on
56:15the public sides of things that we think
56:16about. So, first of all, transparency
56:19and of course transparency means that
56:22the public has a right to know what is
56:24happening in the village government.
56:26Transparency is not optional. We all
56:28know that. We know that transparency is
56:31part of good governance.
56:34This means that the residents should be
56:36able to ask reasonable questions and
56:39receive clear public answers without
56:42having to search for hours or rely on
56:45foil request. Residents deserve clear
56:49public answers before major decisions
56:52are being made.
56:56We all know that communication is
56:58important. When information is withheld,
57:00delay, or delayed, residents are left to
57:02guess about decisions that affect our
57:05homes, taxes, utilities, and quality of
57:07life.
57:09We are looking for good governance. We
57:11really want to build trust. We want to
57:13strengthen accountability. We want to
57:15support informed decisions between the
57:17government and the members of the
57:19community. And as members of our village
57:22government, we remind you that you are
57:24obligated to share information, verify
57:27facts, and to ask what and to act on
57:31what best serves the people of Illan.
57:35So in conclusion, responsible government
57:38is also responsive. It requires clear
57:42answers about things that impact the
57:44community. We we really expect those
57:46answers, but we are not requesting those
57:49favors. We want accountability.
57:52We want to protect our community. And we
57:55ask you to place our interests above the
57:57corporate greed, to fulfill your duties,
58:00and to do your job.

59:42our current mayor outside of a formal

59:54cars that been abandoned for years.

1:01:35of course, the last one is the easiest

1:01:40streets, and that's people still leaving

1:02:46AI data center, a moratorum, zoning and
1:02:50codes. And the reality is doesn't have
1:02:52to be with personal feelings at all.
1:02:53It's not about any of that. There's been
1:02:56decisions that have been made that
1:02:57people feel very frustrated about.
1:02:59There's finances that people have
1:03:00questions about. We're digging for hours
1:03:02and can't find information as somebody
1:03:04had already touched on. The reality is
1:03:07we've had multiple businesses that have
1:03:09come through Illan for that Remington
1:03:11property and left us with a brownfield.
1:03:13They were never held responsible for
1:03:14that. Our tax dollars are now being
1:03:16invested into cleaning up. Number one.
1:03:19Number two, whether somebody is for or
1:03:22against a data center is not as relevant
1:03:27as the fact that every single person
1:03:29sitting up here right now should want to
1:03:32protect the constituents in this
1:03:34village. including themselves, including
1:03:36their families by ensuring that any sort
1:03:40of development is responsible
1:03:42development. This moratorum, this large
1:03:45electric load moratorum, local law does
1:03:49not do that. what this should be. We
1:03:53know that for those who don't
1:03:55understand, I want to make this really
1:03:56clear. We do not need a moratorum in
1:03:59order to address the zoning codes and
1:04:02comprehensive planning. But those things
1:04:04are not being addressed. So the
1:04:05moratorum while they are will protect us
1:04:09from anything happening so that we can
1:04:11ensure that these updates are hacked for
1:04:14these new age technology industries that
1:04:16our zoning and code do not currently
1:04:18address. We have children. We have
1:04:21elderly, handicapped, day-to-day folks
1:04:24that live here surrounding that
1:04:26property. And the fact that we have not
1:04:28taken the responsibility to really be
1:04:30concerned about this is a problem. We
1:04:32have applications that are in that
1:04:34specifically say data center. Regardless
1:04:36of whether it's proposed or not, we're
1:04:38doing a brownfield cleanup with our tax
1:04:40dollars on a property with the intent of
1:04:43a data center. So playing the game of
1:04:44that's not a concern and not taking the
1:04:46zoning and codes issue seriously is
1:04:49concerning. The moratorium that should
1:04:51be presented and I have researched this
1:04:53and I've talked to people all over the
1:04:55place and the moratorium that should be
1:04:58in place to protect us from any permits
1:05:00happening should specifically be
1:05:03regarding the development, construction
1:05:06and operation of data centers and
1:05:08commercial cryptocurrency mining
1:05:09operations within this village.
1:05:12Regardless of anything, I understand
1:05:14that there is some testy subjects with
1:05:16this. This is not about combating
1:05:18anymore. This is about taking some
1:05:19serious consideration for the people of
1:05:21this village. Yes, we bought the
1:05:23property zoned, surveyed a certain way,
1:05:25whatever the case is, but we haven't
1:05:27been protected. We haven't been
1:05:28considered and it and we all live here.
1:05:32We all live here.
1:05:34I just really hope that the health,
1:05:37safety, well-being, and the future of us
1:05:40is considered in this going forward. It
1:05:43has to be. It doesn't need to be against
1:05:46and for anyone for and against a data
1:05:48center should really want this. They
1:05:51really should. And and I I can't
1:05:52emphasize more, but I really hope that
1:05:54you guys really think about this. And
1:05:56this more time presented tonight, isn't
1:05:58it? It shouldn't even be wasted on a
1:05:59public hearing. So,

1:13:28and uh water personnel recommended as

1:16:10one of the founding members. Um I I was
1:16:14involved in that. It was a good thing.

1:16:29because the New York Power Authority is
1:16:32the only source of power generation
1:16:37left in New York. Um
1:16:41uh and we think that uh Illiam would do
1:16:46much better with the power authority
1:16:49because we get when you're a full
1:16:51requirements customer of the power
1:16:54authority, you get preferential
1:16:57um pricing and you get preferential
1:17:01treatment in the queue for who's going
1:17:05to get.
1:17:07So uh I think there's no harm in giving
1:17:12our proxy. This would effectively give
1:17:16Illiam's voting proxy to the board of

1:17:25old days, we used to go to all the

1:29:16responsible for monitoring a popcorn or
1:29:18dance. Weekends are busy and shifts are
1:29:19stacked at minimum compliment. H having
1:29:21a police department next door does not
1:29:23mean officers will keep an eye on
1:29:24things.
1:29:25>> Uh the police department is located
1:29:27along the northernmost set of windows in
1:29:28the auditorium. The back entrance to the
1:29:30police department can become very busy
1:29:32place when we have people in custody and
1:29:34need to move them around to avoid
1:29:35contact with other prisoners or victims.
1:29:38The police department parking lot is
1:29:39just as busy. Dances are held in the
1:29:41evening hours. Uh are they going to be
1:29:43providing chaperoons outside making sure
1:29:45the children remain away from or out of
1:29:47the police parking lot parking lot. The
1:29:50last thing anyone would want is for a
1:29:52child to be struck by a police vehicle
1:29:53responding to a call or someone else
1:29:55driving into the police parking lot for
1:29:56an emergency.
1:29:58Are they limiting or monitoring the
1:30:00number of attendees? What can the
1:30:02building safely and properly hold within
1:30:03the auditorium area? The building itself
1:30:06is aged and no longer appropriate for
1:30:07dances. The ceiling needs repairs above
1:30:09the stage and is noticeably crumbling
1:30:11out of the stage flooring due to
1:30:13problems involving the roof. Children
1:30:16never stay off the stage. It's too
1:30:17tempting. Are we prepared for the
1:30:19liability if a child jumps, falls, or
1:30:20somehow manages to become injured while
1:30:22playing or sitting on the stage? The
1:30:25flooring in the auditorium isn't well
1:30:27sealed, well protected if drinks or food
1:30:29were spilled on them. It's also slippery
1:30:31when it gets wet. The entryway into the
1:30:33building is all railings and stairs.
1:30:35Keeping children off those locations is
1:30:37a difficult task, assuming the
1:30:39individuals hosting the dance have
1:30:40enough shaper inside the auditorium
1:30:42itself. They will also have to ensure
1:30:44direct adult supervision with within the
1:30:46entryway areas of the building.
1:30:50She states she responded to a call
1:30:51several years ago involving a child who
1:30:54was sitting on the railing with several
1:30:55other children when she fell backwards
1:30:57and sustained injuries of struck in the
1:30:58concrete basement floor below. Children
1:31:01don't ever think about bad things
1:31:02happening until they do. Thankfully, on
1:31:04the date, the child only sustained a
1:31:06broken arm. It could have been far
1:31:08worse. I believe the incident occurred
1:31:09at a dance held in the auditorium. I
1:31:12believe may it might have been one of
1:31:14the last dances held in the auditorium.

1:45:58the alien alien residents have 16
1:46:00megawatt correctly.
1:46:03Um this would not anything going to um
1:46:09any power input into Remington's arms
1:46:11would not affect the village residents
1:46:13at all.

1:52:42have done this, the cost has been uh
1:52:44well managed. Um I'm talking $50,000 or
1:52:47less. So I don't know where we're
1:52:48anymore. Okay. Um
1:52:52so the cost is irrelevant. Second of
1:52:54all, these costs, all right, which I'm
1:52:56pushing and will continue to push, are
1:52:58going to be eventually part of
1:53:00tournament responsibility or any other

1:53:08agreement needs to be established. A

2:08:15the village of volunteer downtown
2:08:18cleanup. The village would coordinate a
2:08:20volunteer downtown cleanup day in the
2:08:23fall and the spring and provide garbage
2:08:25bags for the residents, businesses,
2:08:26community organizations, and other
2:08:28volunteers who wish to help participate.
2:08:30[clears throat] Volunteers would collect
2:08:31litter and other appropriate debris
2:08:33throughout the designated cleanup areas.
2:08:36The village would then have the crews,
2:08:38our DPW crews collecting faster garbage
2:08:41bags, transportation down. The cleanup
2:08:44would begin in the areas surrounded that
2:08:45we obviously mark off. we do certain
2:08:48sections. Um, and that's how it worked.
2:08:51The village would provide garbage bags
2:08:54for everybody participating,
2:08:56establish a date, which I've already
2:08:58talked to DPW they were on board with,
2:09:00and I told them that I would actually
2:09:02let them set a date for their slow time.
2:09:04Eric was very appreciative. He said that
2:09:06would be great. He would let me know
2:09:08approximately 2 to 4 weeks ahead so we
2:09:09could advertise it and get a good
2:09:11turnout to help clean up. Um, it'll run
2:09:14pretty similar to what you guys do at
2:09:15the Marine Out.
2:09:18Um, and it just says that residents and
2:09:21businesses will be encouraged to
2:09:23participate by cleaning [clears throat]
2:09:23out the sidewalks, areas, surrounding
2:09:25their properties, and other designated
2:09:26public areas. So, that's from Chief
2:09:28Monahan of what he put together. I
2:09:30thought it was a great idea

2:13:00concept of a uh skating rink is
2:13:02something that um we enjoyed and
2:13:04something that we uh need for the
2:13:06village did in the 1940s and50s. How
2:13:09could they not do it? We did a lot of

2:15:15right now is to eliminate that site and
2:15:18that issue um at both places. And uh we
2:15:22are in the review this administration
2:15:24again we are in the preliminary stages
2:15:27of obviously uh coming up with grant
2:15:29money for McGomery Street Park and also
2:15:32looking into improving Russell Park. So
2:15:34um before we bring those um equipment in
2:15:37whatever obviously we want to take care
2:15:39of maintain it the way it should be
2:15:40maintained and uh resolve this
2:15:42long-standing issue and get the proper
2:15:44facilities if we have one in there. So
2:15:46this is the start of it. Um,
2:15:50>> absolutely. So, I have been working very
2:15:53hard for 8 weeks now parks. Um, and I
2:15:57have compiled lists here from tons of
2:16:00people who reached out to me or just
2:16:01what I've seen myself and um I have met
2:16:06with Mary Joe and we do have a very nice
2:16:08plan that I feel that will move us
2:16:10forward. Um, the first thing being is
2:16:13that I talked to Eric at DVW because I
2:16:18feel that his opinion is very important.

2:16:23he said and agrees with me that both
2:16:26bathrooms need to be taken down at
2:16:27Russell Park. So, the other level needs
2:16:31to be knocked down. It has not been used
2:16:33over 20 years. There's nothing that's
2:16:35going to be a loss of it. that's just a
2:16:36sore ionizers and it just draws the
2:16:40wrong products. So he agrees that he we
2:16:44would not it would not cost us anything
2:16:46cuz we could do this in house. So our
2:16:48DPW would be able to knock that down and
2:16:51level that and we could make it just
2:16:53that alone make it look better. My
2:16:56second thing is the lower bathroom on
2:16:58the lower level used to be something
2:17:00really nice. For anybody who doesn't
2:17:02know they used to have a kitchen to rent
2:17:03out, the bathroom etc. it was a great
2:17:05place to go. Unfortunately, that is no
2:17:08longer the case. So, we also talked and
2:17:10Eric recommends that we also map that
2:17:12down. Um, and we will look into
2:17:16purchasing a new bathroom for down there
2:17:19at the lower level that is new, updated,
2:17:22and safe.
2:17:24Um, and while they have their equipment
2:17:27out, we also want something to park
2:17:31because that building is also not usable
2:17:34in old bathroom and in the middle of our
2:17:37park which we don't want. So all of this
2:17:40can be taken care of in house now that
2:17:42DPW slows coming up and they are willing
2:17:44to do it and agree with everything that
2:17:46I just said. So I would like a motion to
2:17:48have all of that done so that they can
2:17:50proceed on their surveys.

2:21:42So we've been working very hard to bring
2:21:44stuff back to the village and to approve
2:21:46everything. As you can see we just had a
2:21:48recent meeting so that's why we are
2:21:49filled with stuff to get approved. Um,
2:21:52so the parks and reccks are asking for
2:21:54our holiday event to be December 4th and
2:21:585th. Um, the fourth will just be our
2:22:02tree lighting as normal. Obviously, the
2:22:05same normal things we do, have drink or
2:22:07come over, bring Santa in, etc. Um, the
2:22:09fifth will be our all day event that
2:22:11we've had in the past. Everybody's
2:22:13familiar with that. Our, you know, our
2:22:15music and our um, cracker. Yep.
2:22:20So, and our horse carriage mariju.
2:22:40But the 23rd we would like to play um
2:22:43our Halloween movie in here like we did
2:22:45for Christmas a few years ago when I had
2:22:47it. Um and our parks and racks would be
2:22:50there to handle it.

2:23:30that's coming up
2:23:32on that.
2:23:34I don't I just know that um it is being
2:23:36held by Michelle Hmel who does lots for
2:23:39our village and I feel that it has um
2:23:42already given back to that and I would
2:23:45make a motion to make her fee.

2:23:48village. Uh I believe the fees like 30
2:23:51bucks.

2:23:53them to have their food truck there for
2:23:54their opening their fundraising type
2:23:56thing. And I I think it would be good
2:23:58for us.
