0:00These sheriffs are pretty fed up with
0:03Kathy and Letitia simultaneously. Kathy
0:07and Letitia are getting sued by 15
0:10sheriffs in the state of New York
0:12because they're telling these guys
0:14they're not allowed
0:16to team up with ICE on anything anymore.
0:18No, no, no, that's against the law. You
0:20see, here's the headline, New York
0:21sheriffs sue over Hochul's anti-ICE law
0:24that bans government cooperation. And
0:26she's like, "Oh, yeah, whatever." Here
0:28she is actually on Tuesday as she
0:31unveiled all this, and now they're
0:33coming back and saying, "Yeah, no way.
0:35It's not going to work like that." Not
0:36to mention, I'm just going to point out
0:37this seems to be in violation of federal
0:39law. Anyway, here's Kathy.
0:41>> ICE can no longer use locally funded
0:43police to carry out the Trump
0:45administration's aggressive immigration
0:48agenda.
0:49Local cops cannot be ordered to aid and
0:51abet an out-of-control agency.
0:55>> Oh, out-of-control agency. And she
0:58doesn't want them helping. She's
0:59accusing them of going out and rounding
1:01up people on the street, which they're
1:03saying, "No, that's not actually what's
1:04going on at all." What's going on is
1:07that we have
1:09jurisdiction or the ability or uh
1:12wherewithal to work with ICE
1:16when they have someone that they know In
1:19other words, if you commit a crime and
1:20you wind up in one of their jails, one
1:22of the county jails, wherever it is in
1:23the state of New York,
1:25and you are on ICE's list, they can
1:28share that information. They can
1:29actually say, "Hey, you know, we're
1:30going to turn you over to ICE." But
1:31Kathy doesn't want them doing that. I
1:33mean, we we've been through this before.
1:35Remember that was a big problem.
1:37Tom Homann was really upset about that.
1:39Eric Adams was upset about that in the
1:41city of New York. And now Kathy's trying
1:44to make it illegal for you to actually
1:46work with ICE once they're in the
1:48prisons. And you know,
1:50the sheriffs don't appreciate this very
1:52much cuz they they see her as kind of
1:54overstepping her role, not to mention
1:56being in violation of what has already
1:59been allowed for under federal law
2:01because Congress put this in. This
2:03particular law that allows for this
2:05coordination back in like 1996 or
2:08something. And so now there's a counter
2:10suit going on. So they sued her and then
2:14Tishie baby never met a lawsuit she
2:16doesn't want to engage in. Tishie baby
2:18and Hochul came back and they said,
2:20"Well, we're going to sue you guys."
2:23I mean, come on.
2:25>> Hochul and James both announced a
2:27counter suit accusing him of breaking
2:30that law. Hochul claims his county isn't
2:32serious about New Yorkers safety. James
2:35meantime says the Rensselaer County
2:38Sheriff's Office has been given every
2:40opportunity to follow the law yet has
2:42chosen not to. My office is suing to
2:44enforce New York's laws and ensure that
2:47local law enforcement agencies remain
2:49focused on their most fundamental
2:51responsibility, keeping New Yorkers
2:53safe.
2:55>> Okay.
2:56You know, um
2:58if you were going to keep them safe, I'm
3:00going to go out on a limb and say maybe
3:03you want to get rid of the criminals
3:04that are already in the jails that are
3:07here illegally.
3:09I mean, just you know, like so we can
3:10keep our priorities straight. I mean, if
3:12it's so important to keep everybody
3:13safe, of course, as they're saying.
3:15Anyway, there's this something that was
3:16put into the federal law. It's something
3:18called the 287 program. It was signed in
3:211996 as I was mentioning and basically
3:23it allows for ICE to train certain local
3:27law enforcement officers and allows for
3:30them to perform specific immigration
3:32related functions. So in other words, if
3:34you're arrested for a crime and you go
3:37into the slammer there in the county,
3:39the sheriff can say, "Yep, okay, we are
3:41now going to basically work with ICE to
3:44get you
3:45out of our jail and into the hands of
3:48the feds and you can probably get
3:50deported." But her administration is
3:53saying, "No, no, no, this is this is
3:55some form of civil immigration
3:57enforcement." I mean, they're like, "No,
3:59it's not civil because they're already
4:01in the jail because they've already
4:02committed a crime." Here's the county
4:05sheriff in Rensselaer County, um he was
4:07on earlier today on Fox with Julie
4:10Banderas, and he was explaining the
4:12problems that they're having. He's one
4:14of the guys that's suing.
4:15>> This law is really dangerous, Julie. Uh
4:18it was signed into law in May,
4:21and then it just became effective on
4:22Tuesday.
4:24Uh what the law does is it limits our
4:26cooperation with 287G uh as far as
4:29entering into contracts. It also uh
4:32allows it takes away the ability for a
4:34sheriff to house in ICE inmates, and
4:37then it also has created the office of
4:38immigrate immigrant trust. And we find
4:41that extremely troubling uh that the
4:44governor and the uh attorney general
4:46have created an agency within the
4:49attorney general's office to investigate
4:51sheriffs
4:52uh just to make sure they're in
4:53compliance with the law.
4:56>> Woah. Woah. Woah. Um
4:59>> [clears throat]
5:00>> I I it's really sort of amazing because
5:02I I'm looking at Kathy, and I'm looking
5:04at Tish, and it's like, "Guys,
5:06you you have so much TDS. You hate him
5:09so much that even when there's an
5:12opportunity to do the right thing, and
5:14even though you've historically been
5:15doing this, you are now backing away
5:18from that, and you're saying, and this
5:20is the hypocrisy of it all, you're
5:21saying that you're doing it in the name
5:23of safety.
5:24If you want to keep your streets safe, I
5:26would suggest that the criminals that
5:28are in your county jails, you actually
5:30deport with
5:32the help of ICE, all right? So, the
5:35deportation thing is important. The
5:36other thing is like, guess what? It
5:38costs money to keep them there.
5:40And so, you're
5:42This is an interesting angle. They
5:43should look at this. I mean, taxpayers
5:44should be really mad because now you as
5:47a New York taxpayer are having to keep
5:50these people that are not even supposed
5:52to be in the country in the first place
5:54and have committed a crime, you're going
5:55to keep them in the jail.
5:57Because Kathy said there's going to be
5:59no handing over of any of them. You
6:02know, this has been going on and on and
6:03on and on and then the law just became a
6:05thing as you know this week and it it's
6:08it it's really kind of concerning. The
6:10other thing you got to think about here
6:12is federal versus state law. I mean,
6:15who's on first, right? If you got
6:17Congress creating the law as they did in
6:191996 287G and they're saying you got to
6:22work with ICE or you can work with ICE
6:25federal law allows for and authorizes
6:27ICE to enter these facilities and enter
6:29these agreements and train local law
6:31enforcement so that they can turn these
6:33people over and now New York is passing
6:36a state law saying, "Don't you dare."
6:39And you're going to get fired and worse,
6:40right? If you dare
6:43to work with ICE. Well,
6:45it seems to me that if you go back to
6:46the supremacy clause, right, in the
6:48Constitution, that actually the federal
6:50government would have jurisdiction over
6:51this one. And I think the sheriffs have
6:53an argument with that. And then the
6:55other argument they have is, "Hey, hang
6:57on. We're just doing our job." And if we
7:00voluntarily want to work in cooperation
7:03with federal law enforcement, then we
7:05should be able to. And she's saying,
7:07"Nope. Nope. Nope. Nope. Nope. Nope.
7:08Nope." So, this is going to be a big one
7:10for the Trump Justice Department. This
7:12is going to be basically um a look at
7:15sort of again that whole state versus
7:18federal government. And look, you know,
7:20we've seen it before and we've certainly
7:21seen governors before in history. You
7:24can go back to the '60s, right? And
7:25George Wallace and
7:27University of Alabama, if you would, you
7:30know, they're trying to
7:31stand at the door and stop federal law
7:33enforcement from allowing for students
7:36to be integrated in the school. I mean,
7:39a different kind of story, but still
7:41relevant in that it is once again the
7:44state thinking that it calls the shots
7:47when you have
7:48the feds
7:49in charge of one immigration and two
7:53with a law on the books allowing for
7:55this ICE integration into these jails
7:58locally. So, I I just got to say, you
8:00know, can a governor use state power to
8:03override the feds? I don't think so. I
8:05don't think so. I don't think that's
8:07possible. I mean, I know that she
8:09doesn't necessarily have to engage in
8:11and commit resources to helping ICE. She
8:15can say, "Well, that's your
8:16jurisdiction." But
8:19if somebody
8:21is in the jail already and you have a
8:25law and a carve out that allows
8:29for ICE to work with these states and
8:32you have
8:33sheriffs in these various counties. I
8:35mean, there's 15 of them suing her that
8:36want to work with ICE, then what is
8:38going on? I mean, really and truly, what
8:40is going on? It's all messed up.
